The Sacramento County Department of Voter Registration and Elections (VRE) is aware of a U.S. Department of Justice announcement that two Sacramento County residents have been charged with voting by an alien in a federal election.
Criminal charges are allegations, and all defendants are presumed innocent unless and until proven guilty in a court of law. VRE has flagged voter information for the two individuals and will determine any further action based on the outcome of the federal proceedings and guidance from the California Secretary of State, who is “solely responsible for determining eligibility for voter registration, voter preregistration, and voting” (California Elections Code Section 2263(b)).
Under California law, individuals registering to vote must attest under penalty of perjury that they are U.S. citizens and meet applicable voter eligibility requirements. VRE follows applicable federal and state laws and procedures, as well as guidance from the California Secretary of State, in maintaining voter registration records and addressing questions of voter eligibility. VRE will continue to administer elections in accordance with the law.
